Woody’s Beach Rentals Terms and Conditions
1. Rental Agreement
By checking the box indicating agreement to these terms, the Renter acknowledges and agrees to abide by all terms and conditions set forth herein when renting a golf cart and/or other beach equipment from Woody’s Beach Rentals.
2. Rental Period
The rental period begins at the time the equipment is picked up or delivered and ends when it is returned to Woody’s Beach Rentals. Late returns will incur additional charges.
3. Rental Fees
Rental fees are due in full at the time of rental. Fees are based on the duration of the rental period and the type of equipment rented.
4. Security Deposit
A security deposit of 50% of the rental fee is required at the time of booking. The remaining balance will be charged upon the day of arrival. This deposit is not refundable as it is part of the rental price. Any charges for damage or late return will be an additional cost.
5. Equipment Condition
The Renter agrees to inspect the equipment upon receipt and report any existing damage or issues immediately. The Renter is responsible for returning the equipment in the same condition.
6. Use of Equipment
The Renter agrees to use the equipment only for its intended purpose and in a safe and responsible manner. The Renter must comply with all local laws and regulations.
7. Water Damage
The Renter is responsible for any water damage to the equipment. This includes but is not limited to damage from saltwater exposure, submersion, or excessive moisture. The Renter agrees to pay for all repairs or replacement costs resulting from water damage.
8. Body Damage
The Renter is responsible for any body damage to the equipment. This includes but is not limited to dents, scratches, cracks, and other forms of physical damage. The Renter agrees to pay for all repairs or replacement costs resulting from body damage.
9. Other Damages
The Renter is responsible for any other damages to the equipment, including but not limited to mechanical failures due to misuse, tire damage, and loss of equipment parts. The Renter agrees to pay for all repairs or replacement costs.
10. Prohibited Activities
The Renter agrees not to:
- Operate the golf cart or equipment under the influence of alcohol or drugs.
- Allow unlicensed drivers to operate the golf cart.
- Use the equipment in a reckless or unsafe manner.
- Operate 1 hour prior to sunrise and 1 after sunset.
11. Liability
The Renter assumes all risks associated with the use of the rented equipment. Woody’s Beach Rentals is not liable for any injury, loss, or damage arising from the use of the equipment.
12. Indemnification
The Renter agrees to indemnify and hold harmless Woody’s Beach Rentals from any claims, damages, losses, liabilities, and expenses arising out of or related to the Renter’s use of the equipment.
13. Termination
Woody’s Beach Rentals reserves the right to terminate the rental agreement at any time for violation of any terms and conditions or for any reason deemed necessary for the safety and well-being of the Renter or the public.
14. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the state in which Woody’s Beach Rentals operates.
15. Entire Agreement
This agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or representations.
